What is Marriage Certificate?

A Marriage Certificate is a document that shows social union or a legal contract between two people getting into a relationship. A marriage certificate contains the important details of marriage such as the couple, guardian, witnesses, and the authorized person who solemnized the marriage. In UAE, the certificate is issued by government department and is considered a legal document that can be used as a proof of marriage. For any purpose, the marriage certificate then needs to be attested and translated in Arabic Language to use it within the premises of UAE.

Getting a Marriage Certificate in UAE:

Marriage is defined in UAE law as a legal contract between a man and a woman, with the goal of safeguarding the couple’s and their children’s rights. 

Requirements as per law:

The following are the general requirements for a marriage to take place:

  • The bride’s consent
  • Both the bride and groom must have UAE Residency Visa to register a marriage in UAE. However, in Dubai, at least one party (husband, wife, or wife’s guardian) must have a residency visa in the UAE to marry in Dubai.
  • A Pre – Marital Medical Test

Registering a Muslim Marriage:

Marriages can be consummated in the UAE by both nationals and expatriates. Islamic weddings in the UAE are governed by Sharia law, which apply to the following situations regardless of nationality:

  • Muslim groom marrying a Muslim bride.
  • Muslim groom marrying a Non-Muslim from ‘Ahl Al-Kitab’, for example, an Indian Muslim marrying Jewish American bride.

Please note that it is permissible for a Muslim Man to marry a Non-Muslim Lady, but it is not allowed for a Muslim girl to marry a person from Ahl Al – Kitab unless he reverts to Islam.

It is allowed to have more than one wife for a Muslim Man if he does justice and takes care of all wives equally.

 

Legal requirements for Muslim marriages:

  • The marriage is conducted in the Shariah Court.
  • The legal age to marry is 18
  • Medical certificate is mandatory.
  • Bride’s Father or Wali, as the bride needs consent of her guardian.
  • If for any reason bride’s father is not present, elder brother can accompany the bride.
  • Apart from Wali, two male Muslim witnesses from each side are required.
  • If the bride is a reverted Muslim, she may need a ‘No Objection’ letter from her country’s consulate due to non-presence of Muslim Parents.

Marriage of non-Muslims in the UAE:

  • Non-Muslims can complete their marriage requirements at their country’s embassy or consulate in the UAE, or at a temple or church according to their religion.
  • Some countries require nationals to file an intent to marry application with their embassy or consulate in the UAE. Prior check with your embassy is necessary.
  • Marriage registration in respective countries’ embassy is also required

Mixed Marriage Registration:

If the Bride and Groom belong to different countries. The process may vary according to bride’s nationality.

For example, If the groom is Pakistani Expat in UAE and the bride is Russian Muslim. The bride may require a letter of no objection from the Russian Embassy in UAE.

Getting Foreign Marriage Certificate Attested in UAE:

Step 1: Get your certificated stamped from the Home- country Concerned Department.

Step 2: Get it attested from the Ministry of Foreign Affairs or Ministry of External Affairs in the home country.

Step 3: Get it Legalized and stamped from the UAE Embassy in the home country.

Step 4: Apply for Attestation by Ministry of Foreign Affairs (MOFA) in UAE.
